5th Pay Commission DA Case: When will you get dearness allowance (DA) dues of West Bengal government employees? The government employees of the state are waiting for it for a long time. The case related to due dearness allowance of West Bengal government employees is pending before the Supreme Court. 

Government employees have eyes on the Supreme Court, all their hopes depend on the judgment of the Supreme Court.The hearing regarding the dearness allowance arrears will be held in mid-January. According to the notice published on the website of the Supreme Court, the case related to dearness allowance may be heard in the apex court on January 16. 

Once before this hearing was not held due to lack of proper documents. And once the Supreme Court asked both parties to submit their statements in written form.No specific date has been announced as to when the next hearing will be held in the case related to arrears of dearness allowance. But probably 16th January has been taken as the date.

This case was raised in the Supreme Court in December last year. The Supreme Court fixed the next hearing of the case in the third week of January. At that time, Justice Dipankar Dutta recused himself from the case related to the dearness allowance due. It is known that this case will be heard by forming a new bench.

Devprasad Halder Mahashay, convenor of Unity Forum of State Government Employees Association, said, “This stubborn government will give DA without turning its nose to the Supreme Court. Rub the nose, then give DA.”

On May 20, 2022, a division bench of Calcutta High Court ordered that all state government employees should be paid dearness allowance within three months. No dearness allowance arrears have been paid to any government employee within the prescribed period. The state government filed a reversal petition in the High Court. A contempt of court complaint was filed against the state in the High Court.

The state government may spend about 42 thousand crore rupees to meet the outstanding allowances of the government employees of the state government. For now, everyone, from the state government to government employees, is looking forward to the Supreme Court hearing.
